1. Overview

By purchasing the SmartSites™ Standalone Website (“Service”), you (“Client”) agree to the following Terms of Service as outlined by Rank Lift, LLC (“Provider”). This one-time website package is built using proprietary AI technology, custom WordPress infrastructure, and best-in-class web performance standards.

2. Package Details and Deliverables

A. Pricing

  • Customized One-Time Payment: Includes design, development, AI-assisted content generation, and delivery of up to 10 fully-built web pages.
  • Monthly Hosting Fee of $149 (optional but recommended): Includes managed hosting, security updates, daily backups, and up to 30 minutes of monthly content or design updates.

B. What’s Included

  • Up to 10 Pages: Professionally designed pages with AI-assisted copywriting and layout tailored to your business.
  • Proprietary AI Platform: Site is built on a custom WordPress theme powered by Rank Lift’s proprietary SmartSite™ AI tools.
  • Mobile-First, Speed-Optimized Design: Designed for maximum speed, responsiveness, and user experience across devices.
  • SEO Foundation: Every page is optimized with relevant metadata, alt tags, title structure, and schema markup to help search engine visibility.
  • Client Access: You will receive WordPress admin access to update, publish, or modify your content.
  • HTML Export Option: If you choose to cancel hosting, we will provide an HTML-only export of your site for use on a different host.

3. Hosting & Platform Details

  • Platform: All websites are powered by WordPress and a proprietary SmartSite™ theme which includes embedded AI and SEO features. These features are non-transferable.
  • Termination of Hosting: Upon cancellation of hosting services with Rank Lift, LLC, the proprietary theme and AI functionality will no longer be accessible or usable. Your site will continue to function as a static HTML export.
  • HTML Export: Upon request, we will provide a downloadable HTML version of your website. This is a static version that does not include CMS access or SmartSite™ functionality.

4. Ownership Rights

  • During the Build Phase: All creative assets, copy, and code remain the property of Rank Lift, LLC until payment is completed in full.
  • After Final Payment: Upon full payment, ownership of the website’s design and written content is transferred to the Client. However, proprietary SmartSite™ technology (themes, plugins, or backend software) remains the sole intellectual property of Rank Lift, LLC and is not licensed or transferrable.

5. Update Requests

Clients with active hosting may request up to 30 minutes of minor updates per month, including:

  • Text edits
  • Image swaps
  • Blog post uploads
    Update time does not roll over month to month. Major design or functionality changes may require additional billing.

6. Client Responsibilities

To ensure a smooth build process, the Client agrees to:

  • Provide accurate business and contact information.
  • Respond to content and design approval requests in a timely manner.
  • Avoid submitting any materials that infringe on the rights of others or violate any applicable laws.

7. Payment Terms

  • Payment of the full $1,495 is due before the build process begins.
  • Hosting is billed monthly and can be canceled with 30 days’ written notice.
  • Late hosting payments may result in temporary suspension of the website.

8. Limitation of Liability

Rank Lift, LLC is not liable for performance or security issues that arise after transferring the HTML export to another host. We also do not guarantee specific search rankings or traffic outcomes, though every effort is made to optimize for success.

9. Modifications to Terms

We reserve the right to revise these Terms of Service as needed. Updated terms will be made available in writing, and continued use of the Service indicates acceptance of the revised terms.

10. Governing Law

This agreement shall be governed by the laws of the State of Colorado.

11. Acceptance

By submitting payment for the SmartSites™ Standalone Website, the Client agrees to these Terms of Service in full.
